2. Use of Services

Our Services include an online platform for buying, selling, trading, or donating plants, along with related gardening and property services offered through our sister company, Total Property Services LLC.

You agree to use the Services only for lawful purposes and in compliance with all applicable local, state, and federal laws, including New Hampshire law.

You agree not to:

Misrepresent items you list or trade.

Interfere with the operation of our Services.

Use the Services for fraudulent, abusive, or unlawful purposes.

Attempt to gain unauthorized access to our systems.

3. Communications & Messaging (TCR Compliance)

By providing your phone number, email address, or other contact information, you consent to receive communications from RePlanet, including service-related text messages (SMS/MMS), email reminders, and notifications regarding your account, orders, or projects.

Standard message and data rates may apply.

You may opt out of promotional messages at any time by following unsubscribe instructions or replying “STOP” to text messages.

Transactional communications (such as scheduling, estimates, or invoices) are required for service delivery and cannot be fully opted out.

4. User Content

When you upload, submit, or share information (including plant listings, photos, or messages), you grant RePlanet a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with the Services.

You are responsible for ensuring that your content does not infringe the rights of others or violate applicable laws.

5. Payments, Credits & Cancellations

Payments for services are due as stated in your service agreement or invoice. Plant recycling credits are applied only when RePlanet determines, at its sole discretion, that a plant has market value.

Deposits may be required to schedule service. Cancellation policies will be provided with your invoice or service agreement.

6. Disclaimer of Warranties

Our Services are provided “AS IS” and “AS AVAILABLE.” We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that plants purchased, traded, or transplanted will thrive after relocation.

7. Limitation of Liability

To the maximum extent permitted by law, RePlanet and its affiliates are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim related to the Services shall not exceed the amount paid by you, if any, for the relevant Services.

8. Privacy & Data

Your use of our Services is also governed by our Privacy Policy, which complies with NH SB 255 and explains how we collect, use, and share your information.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of laws rules.

Any disputes shall be resolved in the state or federal courts located in Merrimack County, New Hampshire.

10. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top of this page indicates when the latest changes were made. Continued use of our Services after updates constitutes acceptance of the revised Terms.
